Terms and Conditions of Bidding

1. Bidding takes place in real time. Before using the website, each bidder is obliged to complete full registration and read the Rules and Regulations.

2. Bidding can take place only during an auction.

3. When joining an auction, a Bidder defines the maximum price the Bidder is ready to pay for a LOT put up for auction. The system will automatically set the Bidder’s bid at the minimum amount allowing for outbidding other Bidders’ bids with a bidding increment. Next, as a response to each subsequent bid made by another Bidder, the system will automatically generate a bid at the minimum amount allowing for outbidding the Bidder’s bid with a bidding increment, however, not exceeding the maximum price. If the increase with the bidding increment resulted in exceeding the maximum price – the system will generate as the last bid a bid tantamount to the maximum price. The amount of the bidding increment each time depends on the value of the highest price offered at a given moment, in accordance with the following:

up to PLN 10 – PLN 0.50
up to PLN 50 – PLN 1
up to PLN 100 – PLN 2
up to PLN 500 – PLN 5
up to PLN 1.000 – PLN 10
up to PLN 2.000 – PLN 20
up to PLN 5.000 – PLN 50
up to PLN 10.000 – PLN 100
over PLN 10,000 – PLN 300

In the event a bid for a given LOT is made 3 minutes before an auction is closed, the system will generate additional 5 minutes for the next move and if there are no other Bidders, the system will close the auction at the set time. Each subsequent bid will postpone the end of the auction of the above-mentioned lot by 5 minutes.

4. The purchase price will be increased by a 15% premium plus VAT (18.45% on the net price in total) to be paid by the buyer. The buyer also covers the postage (Rules and Regulations § 4 (7)).

 5. Assistance and technical support concerning bidding can be obtained calling us on +48713168658 every day from 10.00 a.m. to 12.00 p.m.

6. In the event no bids have been received on a LOT, the LOT will not be subject to sale once the auction is closed at any terms.

7. In the event of technical problems during an auction which last more than 6 hours, the auction will be automatically extended by 24 hours.

8. Results of an auction will be available within 2 hours of its close. The system will also generate and email an invoice around 11.00 p.m.

RULES AND REGULATIONS of ONLINE AUCTIONS held by Auction House PhilaWorld Spółka z ograniczoną odpowiedzialnością

 § 1

 
1. This document defines the rules and regulations of online auctions held by Auction House Phila World Spółka z ograniczoną odpowiedzialnością (hereinafter referred to as the “Rules and Regulations”).

2. The Rules and Regulations define the procedure of organizing and conducting by Auction House Phila World Spółka z ograniczoną odpowiedzialnością online auctions that consist in real-time bidding by purchasers of Products being objects of online auctions (hereinafter referred to as the “Online Auctions”).

3. The Online Auctions are organized by Auction House Phila World Spółka z ograniczoną odpowiedzialnością based in Zerniki Wroclawskie, REGON 360107160, acting as the Seller.

4. The Online Auctions will be organized and conducted by Auction House Phila World Spółka z ograniczoną odpowiedzialnością on the following website: www.znaczki-aukcja.pl.

 
5. The Online Auctions may be attended by natural persons, legal persons as well as organizational units with no legal personality within the meaning of Art. 33(1) of the Civil Code, who, once they successfully pass the registration procedure on the website indicated in the point above, may participate in an auction as purchasers (hereinafter referred to as the “Buyers”).

6. The following terms used in these Rules and Regulations shall mean as follows:
- the purchase price – the highest sale price of a lot successfully offered by a Buyer by way of bidding
- the product – postage stamps referred to also as a Lot

§ 2

 
1. The Buyer may be a natural person having full capacity to enter into legal transactions, a legal person, an organizational unit with no legal personality within the meaning of Art. 33(1) of the Civil Code, registered on the website provided in § 1 (4).

2. The Online Auction is open and voluntary.

3. The Buyer may enter the Online Auctions once the Buyer accepts these Rules and Regulations.

§ 3

 
1. A person authorized to participate in the Online Auctions shall have his/her own email address and a password. The Buyer himself/herself defines the registration access data in accordance with the procedure described below.

 
2. The use of the Buyer’s email address and password shall be tantamount to placing a purchase order.

3. The entity referred to in § 1 (5) of the Rules and Regulations, who intends to take part in the Online Auctions, shall:
- fill in the form containing the Buyer’s personal details, email and password, which is available on the website named in § 1 (4) having received an invitation from Auction House Phila World Spółka z ograniczoną odpowiedzialnością,
- accept provisions of these Rules and Regulations.

4. Auction House Phila World Spółka z ograniczoną odpowiedzialnością reserves the right to refuse, at their own discretion, to register a given entity as the Buyer (without giving any reasons) or cancel registration already made. Auction House Phila World Spółka z ograniczoną odpowiedzialnością may exercise the above right in particular when the Buyer violates provisions of the Rules and Regulations and/or does not fulfill (is late with fulfillment) of other obligations towards Auction House Phila World Spółka z ograniczoną odpowiedzialnością.

5. The Buyer shall inform Auction House Phila World Spółka z ograniczoną odpowiedzialnością about each data modification.

6. By providing the data in the registration form, the Buyer agrees to and authorizes Auction House Phila World Spółka z ograniczoną odpowiedzialnością to use them for purposes connected with the Online Auctions held, in particular the sale agreements concluded.

§ 4

 
1. All transactions are made in PLN.

2. The Buyer joins the Online Auctions by logging into his/her account and making a price bid for purchase of the Product equal/higher than the starting price or the price recently offered, with at least the minimum bid increment (hereinafter referred to as the “Bid”).
Bid increments shall amount to:

up to PLN 10 – PLN 0.50

up to PLN 50 – PLN 1

up to PLN 100 – PLN 2

up to PLN 500 – PLN 5

up to PLN 1,000 – PLN 10

up to PLN 2,000 – PLN 20

up to PLN 5,000 – PLN 50

up to PLN 10,000 – PLN 100

over PLN 10,000 – PLN 300

3. Each Buyer shall remain bound by the Bid made during the Online Auction until a more advantageous bid is made.

4. In the event more than one Bid of the same value is made, the order of submission shall be decisive (the bid made earlier shall win). A Bid shall be considered submitted the moment it is registered in the system used to hold the Online Auction. All Bids made by the Buyers are net values.

5. The Buyer shall bear responsibility for the correctness of the Bid made, in particular, it is emphasized that a Bid made may not be cancelled or corrected (mistakes and errors). Bids can be submitted during an auction.

6. Auction House Phila World Spółka z ograniczoną odpowiedzialnością emphasizes that if it sells the Product as a consignee under a consignment agreement, Auction House Phila World Spółka z ograniczoną odpowiedzialnością shall not be held liable for physical and legal defects in the Product sold. This declaration shall be deemed to be a consignee’s declaration within the meaning of Art. 770 of the Civil Code.

7. The purchase price shall be increased by a 15% premium plus VAT (18.45% on the net price in total) to be paid by the Buyer. The Buyer shall also pay the postage.

8. The act of purchasing the Product obliges the Buyer to collect it. The Buyer shall pay the purchase price (including the premium) within 21 days of the purchase of the Product. The Product purchased shall be handed over to the Buyer only after the full amount due is paid within 3 - 14 working days of the day following recording of the funds.

9. Auction House Phila World Spółka z ograniczoną odpowiedzialnością reserves the right to withdraw the Products during an auction without giving any reasons.

10. At the explicit Buyer’s request Auction House Phila World Spółka z ograniczoną odpowiedzialnością shall send additional scans by email. It is not possible to see the Product live.

11. The condition of accepting and initiating a complaints procedure is sending back a LOT together with the VAT invoice/receipt enclosed within 30 days of the receipt of the letter/parcel. The return shall not be accepted if the LOT is destroyed or damaged in any way. Complaints do not apply to combined LOTS and lots described as collections, batches and boards.

§ 5

 
1. Any and all declarations, calls, notices or information shall be delivered to the Buyer by email in conformity with Art. 61 § 2 of the Civil Code to the email address provided by the Buyer in the registration form as the address for deliveries.

2. Messages sent by Auction House Phila World Spółka z ograniczoną odpowiedzialnością by email to the Buyer’s address provided in the registration form shall be deemed effectively delivered to the Buyer on the day they appear on the Buyer’s email server.

3. The Buyer shall immediately inform about each change in the telephone and address details provided in the registration form under pain of considering messages sent to those addresses as effectively delivered.

4. Our website features cookies so that we can provide services of the highest quality. Use of the website without changing settings related to cookies shall mean that you approve our use of cookies.

Important – blocking all cookies on znaczki-aukcja.pl may cause problems with functioning or completely prevent proper functioning of our website.

§ 6

 
1. The Online Auctions as well as all documents prepared as a result of the Auctions (e.g. invoices, requests) shall be made in Polish. Any and all documents provided or submitted by the Buyers shall be made in Polish.

2. Any matters not provided for in these Rules and Regulations shall be governed by generally applicable legal regulations, including, in particular, the Civil Code.

Time of delivery

Time of delivery: 3 – 14 working days of the day following recording of the funds on the Company’s bank account.

Payment deadline: 21 working days.

 Company Guarantee/Certificate

PhilaWorld grants a company guarantee for the lots whose description includes a note saying COMPANY GUARANTEE. The term means that we confirm the authenticity of the postage stamp offered.

The Company issues COMPANY CERTIFICATES (confirmation of authenticity). The term applies only and exclusively to those postage stamps whose auction description features a company certificate. The Certificate is made of paper and features a reproduction stamped with an embossed seal.

The Company holds a civil liability insurance policy No. 1002213125

Complaints and returns

The condition of accepting and initiating a complaints procedure is sending back a LOT together with the receipt or VAT invoice enclosed within 30 days of the day of receipt of the letter/parcel. The return shall not be accepted if the LOT is destroyed or damaged in any way.

Complaints shall not apply to LOTS described as collections, batches and boards.
